Terms

These terms cover your use of Sundown, the app and website provided by Mateusz Nowak, trading as By Nowak (“we”), Rzeszów, Poland. By creating an account you agree to them. Questions and complaints: business@bynowak.com.

Your account

You need an account to use Sundown. Keep your password private. You're responsible for activity on your account. You can delete your account at any time in the app under Account → Delete account.

Price and billing

Try the full app for €5 for 7 days. Then €19/month. Cancel before renewal to avoid the next charge.

Cancelling

Cancel any time in the app (Account → Manage subscription) or by emailing us. Cancellation stops the next renewal. You keep access until the end of the period you've paid for. We don't refund partial periods, unless the law requires it.

Right of withdrawal (EU/EEA customers)

Sundown is digital content and a digital service that starts immediately after purchase. By starting your trial or subscription you ask us to begin right away, and you acknowledge that you lose your 14-day right of withdrawal once the service has started. If you believe something went wrong with a charge, contact us and we'll sort it out fairly.

Using Sundown

Sundown is a personal productivity tool. It isn't medical or psychological treatment. Don't use it to store anything unlawful, or anything you aren't allowed to store. We keep Sundown running and backed up with care, but we can't promise uninterrupted service. Keep your own backup using Settings → Download if your notes are important to you.

Ending or changing the service

We may update Sundown and these terms. For material changes we'll notify you in the app or by email. If we ever discontinue Sundown, we'll give at least 30 days' notice, stop charging you, and let you download your data.

Liability

Nothing in these terms limits rights you have under consumer law that can't be limited. Otherwise, our total liability to you is limited to the amount you paid us in the 12 months before the claim.

Law

These terms are governed by Polish law. If you're a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you can use the EU's online dispute resolution options.
